Dred Scott was a slave in Missouri who moved with his owner in the free territory (Illinois and Wisconsin) before moving back to Missouri. Dred Scott sued for their freedom on the grounds that while they were living in free territory that freed them from slavery.

He took his case through several courts and finally it was decided by the Supreme Court that having lived in a free state did not make him free. It also states as he was someone's property he was not a citizen and could not sue in federal court. He was not a U.S. Citizen.

This was decision was rendered void with the passing of the Thirteenth and Fourteenth Amendments.
