Constitution is considered to be a basic element of the state because:

  • Because it tells you how the state is constituted.
  • It tells us what the different organs of state are and what are its powers and what are not.
  • It tells us how power is shared among its organs.
  • The Constitution highlights the need for independent institutions & that objectives of the political system, such as whether it would be democracy, what kind of a democracy and lastly what people expect from a democratic nation.
  • The constitution gives some guidelines on other functions if the state.They can be done only by the post establishment of the state.
