Answer: Supremacy Clause

The Supremacy Clause ensures the Constitution is the supreme law of the land and the foundation of government. The Supremacy Clause establishes that the US Constitution is above any state law enacted or other law that is passed. Any other laws and government actions must be in accordance with the nation's Constitution. The Supremacy Clause is the second clause of Article VI of the Constitution. It is stated as follows:

  • This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.

The answer is Supremacy Clause. The Supremacy Clause found in Article VI, Clause 2 that federal laws made pursuant to it, and agreements made in its power, establish the highest law of the land. Also, state constitutions are secondary to federal law.
