The constitution explicitly identifies which court(s)

The judiciary, created by Article III of the Constitution, expressly creates the Supreme Court, which will be the head of Justice in the U.S. and the only federal court created in the Constitution.

Other courts would be created later to rule over different jurisdictions and these courts would be created by the Congress.
