Commander in chief of the Armed Forces

Leads the army and armed forces

(President may use armed forces to keep domestic peace)

President is commander in chief of the military. This is saying there is civilian control over the military.

As the commander in chief, he can send off the military into combat, but only congress has the power to declare war.

Difference between military action and declared war.

Last declared war - WWII

Every other military conflict that we have been in have been undeclared military action

Prez can: Negotiate treaties

He can negotiate them with a foreign government and sign them. But they do not have any effect unless the Senate consents or ratified the treaty.

This requires a ⅔ majority (supra-majority; more than the majority in the Senate. The reason is the US does not like being bound by treaties with a foreign country.

Prez can: Nominate

Preisdent can nominate individuals for the judicial branch and executive branch (supreme court justices, ambassadors, and a handful of other principal officers), but these people can not take office before senate agrees.

Prez can: Grant Pardons

The president may pardon for crimes against the us law, not against a state

Ex: Kim K made an argument to convince Mr. Trump to use his pardon power to release Alice Marie Johnson

He can not reprieves or pardon or an impeachment

This can not be reviewed of reversed.

But if he uses his power in obstruction of justice, that would be a problem for

This power acts a check on the judiciary.

Prez has: Removal Power

May remove those approved by the senate

Disability to perform duties of President

Vp may temporarily assume the duties of the office if the prez is in surgery, under anesthesia, not in his/her right mind.

(He/she may only resume by informing the Congress that no inabilities exist

Cabinet & VP may challenge the president's actions

Update congress on the state of the union

President from time to time has to give congress an update on the state of the union.

Back then, prez would send a letter to the congress with the updates of the state of the union. But that changed in the 21st century.

Prez decided it would be good to make the address to a joined session for congress.

Next state of the union is January 29th, 2019

Prez can: suggest legislation

when a bill is given to him, he can suggest to the congress how they can improve and then it will go through the billing process again. ft

Domestic Emoluments Clause

Foreign emolument Clause

Both: Gift or payment, can't take bribes or a suggestion of a bribe

He shall not receive any other emoluments within the country

Meant to avoid conflicts

The idea is no one of the US, can expect anything foerign.

Because if he did that, then that suggests that the president was going to do something the foreign government wants, not the people

Oath of Office

Oath taken by the president on the day he takes office, pledging to "faithfully execute" the office and "preserve, protect, and defend" the constitution.

You do not have to be a believer in god, you do not need to put your hand on the bible to become president.

George Washington added so help me god. Not necessary to say though.
