3. Dennis and Francis Burnham were married in 1976 in West Virginia. In 1977, the couple moved to New Jersey where their two children were born. In July, 1987, the Burnhams separated. Mrs. Burnham moved to California, established residency, and filed for divorce. In January, 1988, Mr. Burnham visited California on a business trip. He also visited his children who were living with Mrs. Burnham. When he returned the children home, he was served with a summons and a copy of the divorce petition. He then returned to New Jersey. My answer is yes. This is known as person jurisdiction. The reason is due to this fact, Me Burnham was actually in california when he was served these court papers. Giving that his ex wife lives there, bother the date and the former wife had jurisdiction even though he doesn't live in the same state as she does. States have a jurisdiction over the people who are physically in that state especially when presence is voluntary.
