If an employee who is working in a hard-hat area is not wearing her helmet, trips over a ladder that has been left in the way, and hits her head, is the employer responsible for the accident? Explain why or why not.

Step-by-step explanation:

The employer is majorly responsible for the accident. It is the the duty of the employer to have provided the employee with necessary personal protective equipment (PPE) needed in the workplace to avoid accident of such. PPE are equipment used by employee in the workplace to avoid unforseen accident during working hour. Some of this PPE is the helmet that the employee was not wearing.

On the other hand, the employee should be held responsible if he had been provided the necessary PPE but refused or forget to use it whatever the case maybe.
