Negotiation is an informal process wherein, without judgment, the parties can feel comfortable sharing their views. To settle a conflict, participants willingly engage in the problem-solving process. Mediation is vastly different from the method of arbitration or trial. Litigation addresses animated feelings and provides persuasive defenses. Mediation helps participants to meet, understand and brainstorm a response to a complicated situation willingly. Mediation requires a satisfactory result for those involved to be reached by the opposing parties; arbitration gives a judge and jury the power to decide the outcome.
