The woman who filed the lawsuit against Henry Wade was Norma McCorvey. When McCorvey was pregnant in her 20s in 1969, he opted for abortion. But at that time abortion was legal only if it was the case for woman's safety. Since McCorvey could not afford to take care of children she had to give her children for adoption after every delivery.

When in 1970, Texas district court ruled the abortion as illegal the case was sought by the Supreme Court under chief justice Harry Blackmun. Blackmun, on 22nd January 1973, declared that to abort one's child was a right to privacy of women under the 14th Amendment.
