When might you choose to use a mediator for a case instead of going to court?

If you and the other party have some common ground.
O So you can avoid having a third-party involved in the case.
If you and/or the other party do not have lawyers.
O So you can have a non-binding decision on the issue.

Answer:

You would only need a mediator if you and the other party could not come to terms on anything. Normally if you can't agree the judge will order you to go to a Mediator and in that case you would have to go in front of a judge before hand because you can't just go to a mediator without a signed order from the judge.
