I hate expanding this question because once you get into it, the answer almost never ends.

The very best example of what can happen is with Roe v Wade. This one judgment changed American politics dramatically. R v W first came about in Texas which had very strict Abortion laws. The original case was fought in Texas and the Supreme Court in Texas up held the claim of the defendent. It was a shocking result, especially in a place like Texas where people are very religious.

Wade, the DA, immediately appealed, and the Texas congress flooded the statutes with all sorts of new laws that weren't questioned or really asked for. These laws determined how the abortion was to take place, who could make the choice and when, and what facilities could be used. It has been debated on both sides for years. And it has become a first amendment issue although it was first decided by the due process clause of the 14 amendment, which is a privacy statement.

In other words, it became a woman's right to be silent about what she is going to do about an unborn fetus. Ordinary citizens were outraged by the decision. Unborn fetus is a LIFE, and that became the argument.
