Now imagine you’re a US judge serving at Fort Smith. A Native American suspected of committing a crime in Indian Territory has fled to the United States. Would you hear the case? If the accused is a tribal citizen, then I would not have the jurisdiction to hear the case. As a US judge, I can only hear cases that relate to US citizens. At the time, Native Americans were not US citizens. If that was the situation, I would send the accused back to Indian Territory to have the case tried in a tribal court.
