Nick Nincompoop, who has never played golf in his life, went with a group of his friends to HiLo Golf Range and Bar. HiLo is noted for its unique quadruple deck driving range with neon lighted targets for night time golf. Nick was swinging at a golf ball when the five iron flew out of his hands and struck Sally Server, a HiLo wait staff person on duty. The five iron struck Sally in the face causing both physical and emotional injuries resulting in hospital, doctors and therapists bills in addition to missed time at work. If Sally sues Nick for the injuries, what are her best possible causes of action and why

However, in general, if Sally suffered injuries as a result of Nick's actions, she may have legal recourse to seek compensation for her damages. She may be able to bring a personal injury claim against Nick, which would require her to prove that Nick was negligent in some way, such as by failing to properly control his golf club or by not following safety protocols at HiLo Golf Range and Bar, and that this negligence caused her injuries. Alternatively, she may be able to bring a claim based on intentional torts, such as battery or assault, if Nick's actions were intentional or reckless. It is important to note that the specific causes of action and legal options available to Sally may vary depending on the jurisdiction and the facts of the case, and she should consult with a qualified attorney for advice on her specific situation.
