Jared was in the construction business. His specialty was upgrading and remodeling spaces. He learned that Mariah was planning to remodel her restaurant. Jared made her an offer to do the work for a specified price. Mariah is considering both Jareds offer and two other remodelers and has not yet made a decision. While she was deciding, Jared made a remodeling contract with another business and so wants to withdraw the offer he made to Mariah. Can he do so without liability? Why or why not

In this case, it is important to consider whether Mariah had already accepted Jared's offer before he made the contract with another business. If Mariah had accepted the offer, then Jared cannot withdraw it without potential liability.

However, if Mariah had not yet accepted Jared's offer, he may be able to withdraw it without liability. An offer can usually be withdrawn before it is accepted, unless the offeror has made a promise to keep the offer open for a specific period of time, known as an option contract. Without an option contract or acceptance of the offer, Jared may have the right to withdraw his offer.

It's worth noting that contract laws can vary depending on the jurisdiction, so it is important to consult with a legal professional to understand the specific laws and regulations that apply in the relevant jurisdiction.

and so….

whether Jared can withdraw his offer without liability depends on whether Mariah had already accepted the offer. If she had not accepted it, he may be able to withdraw the offer. However, if she had accepted it, he may be liable for breaching the contract. Consulting with a legal professional is recommended to fully understand the legal implications in this situation.
