Jason has been dating Samantha for the last 7 years. They met while in high school while living in Boulder Colorado, but now are 24 and have moved to Sedona, Arizona. Jason has been in the streets for the last 6 years selling “blues”, pressed Percocet pills throughout the Phoenix metropolitan area. Jason while in his street activities has gotten into a situation with a female named Cassandra. Cassandra has been homeless for the last 4 years due to her addiction to heroin and fentanyl. She is currently in a relationship with Patrick, a fellow homeless drug addict who occasionally lives in a Super 8 motel by Interstate 10. On February 13th, 2022 Jason met up with Cassandra for a valentines eve date and the two went to the local red lobster. At said date Jason and Cassandra could smell a stench coming in from the lobby of the restaurant. Based on the smell Cassandra knew it was her man (Patrick). Cassandra panicked and ran to the bathroom. Jason took a seat at the bar and staked out the restaurant. Cassandra called Patrick trying to throw him off to leave the restaurant, Patrick knew better and stayed and waited. After 4 hours Cassandra emerged from the bathroom. Cassandra had to go back to the table, after Patrick reminded her that she did not have her purse and wallet she went back to the table. At this point Patrick confronted Jason and pulled out his switchblade. Jason said “yeah, that's my situation. What are you gonna do about me taking your lady?” Patrick took the blade out of his pocket and stabbed it through Jason's throat. Jason was left bleeding out on the floor of the Red Lobster. Patrick took Cassandra by the hand and walked her out of the restaurant with some snow crab legs. 12 minutes later the police arrived on the scene with Jason’s ex Samantha. She looked at his dead body and laughed. Getting into his Ferrari and forgetting he ever existed… What are the charges? And for who? Explain why.
