Frank and Kevin are best friends who get into a fight with a local gang, and
Frank ends up getting severely injured. Kevin puts Frank in his car, puts an
ice pack on Frank's head, and drives around for an hour looking for hospitals
before leaving Frank in the car overnight, where he died as a result of his
injuries. Frank's family sues Kevin in a civil suit for negligence. Who wins
and why?
O Kevin wins, because he put Frank in the car, acted as a reasonable person would
under the circumstances, and did not worsen Frank's condition
O Kevin wins, because the local gang injured Frank, not Kevin, and they are the sole
party responsible for his death
Kevin wins, because friendships alone do not establish a relationship that gives
rise to a duty of reasonable care
Frank's family wins, because Kevin assumed the duty of reasonably caring for
Frank after he was injured in the attack
