Well, that's actually a tough question to answer. A court is actually the last resort of a unresolvable dispute.

Why would anyone go to court to resolve such a dispute, if there was a mandate out there that said. We only find (in these kinds of cases) for the defendant?

So everyone must be seen as equal to anyone else when a court case is being argued.
