The correct answer is B. The ages of the concerned parties

Each state has it's own definition of age of consent. In terms of age what needs to be addressed is whether the parties involved were at or above the age of consent for that state and, does the age difference between the perpetrator and victim affect the age of consent in that state. These are used to determine whether a crime has taken place or not.
