The tenth amendment gives the rights not expressly delegated to the federal government to the states or to the people.
The Tenth Amendment (1791) states that the powers not delegated to the United States government by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people. Its purpose was to address fears that the federal government could abuse its authority and the states and the people could lose some of their rights.
