The policy laid down by the occupational safety and health administration does not ban appropriate disciplinary, INCENTIVE or drug testing programs.
Employers can misuse INCENTIVE as a form of retaliation against an employee for reporting a work place injury.
Incentive programs are programs that encourage safe work practices and promote workers' participation in safety related activities. It is a crime for an employer to use incentive program in a way that penalize a worker for reporting work related injuries.

Employers can't demote, discharge, or deny a bonus or other benefit to an employee for reporting a workplace injury or illness. Employers also can't demean or embarrass the employee (like making them wear an orange vest for a week) for reporting the injury or illness
