The answer to this question is that the defendant is incompetent to stand on trial. A Defendant is a person being accused by doing a crime. If a defendant is being seen by the judge and he or she was seen with an unusual behavior and the defendant is un-capable of understanding the proceedings being laid to him or her by court, the judge or prosecutor may delay the trial or the defendant shall be committed to a mental hospital.
