A legal procedure that prevents the government from holding you indefinitely without showing cause is known as Habeas Corpus. When detention is challenged by Habeas Corpus, the executive branch must give justification for the arrest. It was one of the main pillars in western law. There is a certain limitation of Habeas Corpus, as it is a writ of the right, not a writ of course. although it provides a procedural remedy, it doesn't provide a guarantee against detention, neither does it protect the right as entitlement to a fair trial

The habeas corpus act is a recourse in law whereby a person can report an unlawful detention or imprisonment. habeas corpus has its limitations. it is basically a procedural remedy. though a writ of right is not a writ of course. this differs from a motion in a civil process which the movant need to have a standing.
