This is a question that seems odd for this site but, i'm doing a school paper on student rights and such. A student i know was going off campus for lunch ( with the right to do so from the school ) and he left school grounds and went to a local restaurant and only then did he smoke his cigarette away from school grounds. He is legally able to buy and smoke cigarettes (age 18 ) . He was suspended for the week for doing so, and i cant find anything in our schools policies and or handbook that suggest or say that smoking during off campus lunch is prohibited. Is this violating his First Amendment Rights?

Yes,because he didn't smoke on school grounds and if he didn't bring anything back on school grounds,also he didn't break no rules according to the handbook then his rights has been violated. He is 18 so there isn't nothing wrong with him buying them since he is old enough he didn't commit any crimes so therefore his rights has been violated

Yes this is violating it. He had a yess from the school to leave school grounds so he shouldn't get in trouble for smoking while off school grounds.
