Answer:

Step-by-step explanation:

2 Bakke's qualifications exceeded those of any of the minority students admitted in the two years Bakke's applications were rejected. The Supreme Court ruled that a university's use of racial "quotas" in its admissions process was unconstitutional but a school's use of "affirmative action" to accept more minority applicants was constitutional in some circumstances.

3 It gave the courts a way to test whether an affirmative action program was constitutional using strict scrutiny. They examine whether a program was narrowly tailored to serve a compelling government interest in having a diverse range of students attend college.

4 It wasn't a complete win for either supporters or opponents because it could've went either way, it wasn't right for a university to use racial quotas in its admissions process but if they wanted to create and make the university more diverse then there is nothing wrong with that but it wasn't right for them not to accept Bakke either because he did have a right to enter in that university and get accepted as well as the others.

5 I agree with the opinion held by Justices William Brennan, White, Marshall and Blackmun. Which was the U.C. Davis program being constitutional even though it used a quota system. Affirmative action programs could consider race because people of minority races tend to suffer from discrimination. Those programs are to implement in favor of those people so it makes sense for affirmative action programs to consider race. It presents the best solution because those programs may take race into account when it acts not to demean or insult any racial group but to remedy disadvantages cast on minorities by past racial prejudice.
