First of all, the death penalty is only legal in a handful of states - and especially wouldn't be used for such a minor trespass. Secondly, Creon wouldn't have full control over what happened to Antigone; he would only have a minuscule amount of persuasion. No matter the offense, Antigone would still have rights. Lastly, it's incredibly possible that Creon wouldn't have even been able to make the burying of Antigone's brother illegal. In order for a bill to pass as a law, it has to go through several channels of approval.
