The correct answer here would be that courts continue to find that the First Amendment Right's are not absolute.

What we mean here by absolute is that the rights in the First Amendment can not always be taken at their face value and that they can not be interpreted always with a strict literal interpretation. First Constitution means for example that government can not make national religion and can not make you be a part of that religion. Here we see the same principle in regards to license plates. The government can not make its institutions issue Confederate license plates.
