Under the habeas corpus, any person under arrest has the right to report that their detention or imprisonment was unlawful and to petition to be brought before a judge or into court to justly determine, through the analysis of proofs, whether the detention was indeed unlawful. This recourse in law keeps the authorities, such as police officials, from imprisoning anyone without just reason, that is to say, they can not jail anyone unless charged with a specific crime.
