The primary driver of Congressional boundaries is the majority part of the particular state legislature, who are responsible for drawing the Congressional maps. Some states use a bi-partisan commission, but again, at the state level.

The Federal Government can, however, get involved in the process through the Court system as plaintiffs can challenge particular congressional maps as being unfairly gerrymandered.
