The biggest sticking point or difference between textualists and constructualists is Congress' commerce clause power.

In short, strict textualists narrowly define what Congress is appropriately allowed to do with the commerce clause.

Loose constructualists, pragmatists, and the like see the commerce clause as the engine by which Congress can work to solve a lot of the nation's problems.
