I believe she has.

Under Article 1: Amendment 1: Section 1: Clause 1, Congress cannot be allowed pass any regulations or decisions based on a person’s race, color, ethnicity, or religion. From the case above, we can see that the Congress based its action on Ms. Kite's religion. This provide Ms. Kite with a constitutional basis to protest the decision.
