Mental competency will be determined by the court. Metal competency is the capacity to execute legal contracts. Such a determination is a judicial decision and it is made by courts. One can be determined as incompetent if they are mentally incapacitated or actively psychotic

Do you have to be determined mentally incompetent by the court or can your doctor do that
