The first and most famous test for determining when the government could intervene to suppress political speech was called the "clear and present danger test".
The dominant part on the Court clearly acknowledged in any event part of Holmes' pragmatism. But different judges did not grasp a portion of the nuances inside the test Holmes was attempting to build up. In fact, Holmes needed to substance out the full importance of the "clear and present danger test" inside disputes that he composed on consequent First Amendment cases.
