It's because they give birth to live animals, it wouldn't be considered a mammal if it gave birth to a baby whale that was in an egg.

The biological act of giving birth to their offspring like other land mammals shows that whales are mammals. Whales are also warm-blooded, breathe air through lungs, and produce milk for their offspring.
