False. The reason for the standard of .08 as the "presumption of impairment" is because everybody acts the same way under the influence of alcohol. The guidelines of .08 is so that there is a measurable amount of alcohol that is legal for once person to consume a time and still operate a motor vehicle. Though alcohol can have a fluctuating impairment depending on the person, standards still need to be met for legal reasons.
