A 43 year old healthy male presents to the emergency room with severe abdominal

pain. After a CT scan it was discovered that the patient has appendicitis. The patient is
taken to the pre-op holding area and prepped for surgery. During the prep, the nurse
accidentally puts a different patient's armband on the patient. The patient is taken back
to the operating room and surgery is performed. While in recovery, it is discovered that
the wrong person armband resulted in a left lower leg amputation instead of
appendectomy the patient actually needed. What could the patient sue this doctor for?

Malpractice, or negligence.
