The proof would be the southern states' efforts to prevent black people from voting during the new south era.

During the new south era, the southern states require voters to have a certain level of income and require the the voters to pass a literacy test before they are allowed to vote.

Since most black people just got out from slavery, it was almost impossible for them to pass these requirements. So they weren't able to elect the representatives that were willing to fight for their cause.
