Blake worked for West Oregon Lumber Company
as a wood sorter. In violation of Oregon law, the
company did not carry workers' compensation
insurance. While sorting wood on a table, Blake
knocked a very heavy piece off, and it fell and
hit his foot. Blake sued the employer for negli-
gence as the pieces for sorting should have been
small enough to handle properly. The lumber
company asserted contributory negligence as an
employer's defense. Will Blake win?
