Powers which are reserved for the states need to meet the two following requirments:

  • Powers not delegated by the Constitution
  • Powers not prohibited by the Constitution

The Tenth Amendment to the US Constitution states that "powers not delegated" to the federal goverment wil be exercised by the states. Moreover, this amendment confirms subsequently, that for the states to be able to hold certain powers, those powers cannot be forbidden by the Constitution.
