The answer is that they were drafted after Vicksburg. It was until the near the last few months of the war that the Confederacy used African American soldiers. There were very few freed African Americans in the South and the vast majority of the African American soldiers were ordered to fight when the South began to grow desperate of the North encroaching on Southern territory.
