People detained in battlefields around the world that were suspected of engaging in terroristic activities against the United States were detained at the US military base in Cuba known as Guantanamo Bay. This method of handling suspected terrorists raised outcries about the proper application of laws regarding those accused of crimes.

Based on what you know of the situation, what arguments could be made against holding suspects without allowing for a proper trial?
What argument could be made for holding suspected terrorists without formally charging them with crimes and giving them a day in US court?

One can evoke the Universal Declaration of Humans, articles 9 and 10 assert the right of fair judgment and one can add that it is based on the simple fact that all of us want fair treatment and not arbritary justice.

On the other hand, maybe to save the lives of thousands of people, sometimes it wouldbe necessary strong coersion to get vital intel on the location of a dangerous leader or weapons of mass destruction.

FOR ARGUMENTS:

  • Terrorists could be sent to jail and the world would be a safer place for peaceful people.
  • USA was able to win war on terror

AGAINST ARGUMENTS:

  • many criminals held in jail may not be criminals at all
  • without a court's judgement,it is illegal to keep people in jail.
  • several detainees were tortured without trial,which is illegal.
  • breach of human rights of the detainees
